For the last 15 months I've been a mess on and off due to being broken into and assaulted. Up until 4-5 months ago I managed to hide it and keep it to myself.I finally went to the doctors and I've been diagnosed with severe depression and anxiety. I have been struggling at work and I don't know what else to do other than quit.
Can anyone help me with what my rights are? I can't go back as it's not a healthy environment and I even get panic attacks driving to work. I have next week of from my Doctor's recommendations. but what am I supposed to do? I have some holiday leave and I'm worried that I won't get it if I don't give them notice.
Help!!!!

Hi Sunsets
Welcome to the bb forums.
I am so sorry to hear about the trauma you have suffered but so very pleased to hear that you have reached out for help. Most people with depression and anxiety recover with proper treatment, so please know that it will get better. You are on the right track.
I can understand your mental health condition affecting your ability to work. I'm not sure from your post that I understand how work is contributing to your illness. It sounds like you are saying work is also making you unwell. Why is work an unhealthy environment? Are you being bullied or harassed?
Depending on what is happening at work you may be able to lodge a WorkCover claim. There is a process to follow to go down this path and it varies across Australia but in essence you would receive financial support while you deal with your illness and assistance to eventually return to work. I have some knowledge in this area and am happy to chat more about this if you think it would help you.
Rather than give you potentially incorrect advice about your leave entitlements and required notice period, I suggest that you contact the Fair Work Ombudsman. Start at fairwork.gov.au
Once you have the correct information for you, I would be happy to chat with you about how to approach your employer (I am an employer with some 150 staff). We often pay departing staff out without making them work their notice period, for a variety of reasons. It will most likely depend on the relationship you have with your employer and the details of what is actually happening at work.
Feel free to keep posting--and not just about your work rights. If you need support around your illnesses there are many kind, caring people that can help.
Kind thoughts to you
